THE CASE
A petition filed by Save India Foundation, concerning Madina Masjid, Gali No. 9, Max Wali Road, Shalimar Bagh, was taken up before the District Court at Rohini.
Following receipt of the civil petition, MCD conducted an inspection on 20 August 2026 and recorded unauthorised construction comprising multiple floors, projections onto municipal land and additional walls/columns. MCD subsequently issued a show-cause notice under Sections 343/344(1) of the DMC Act.
The mosque management was given a personal hearing on 3 September 2026. After a further inspection, MCD recorded that the unauthorised construction had not been removed and passed a Speaking Order directing its removal within 15 days, failing which demolition action would be initiated and the costs recovered under the DMC Act.
On 23 September 2026, demolition of portions of Madina Masjid and adjoining structures took place.
